It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Title 42 of the General Laws entitled "State Affairs and Government" is |
|

hereby amended by adding thereto the following chapter: |
|

     CHAPTER 42-12.4 |
|
1-4 |
BRAIN INJURY TRUST FUND |
|
1-5 |
     42-12.4-1. Title. -- This act shall be known as the "Brain Injury Trust Fund." |
|
1-6 |
     42-12.4-2. Authorization. -- There is hereby created a "Brain Injury Trust Fund" to |
|
1-7 |
provide brain injury services to residents of this state who have acquired a traumatic brain injury. |
|
1-8 |
     42-12.4-3. Definitions. -- For the purpose of this chapter: "traumatic brain injury" is |
|
1-9 |
defined in section 42-12-21. |
|
1-10 |
     42-12.4-4. Oversight. -- (a) The brain injury trust fund shall be overseen by the |
|
1-11 |
permanent advisory commission on traumatic brain injuries established by section 42-12-19. |
|
1-12 |
     (b) The commission shall establish priorities and criteria for disbursement of monies in |
|
1-13 |
the brain injury trust fund and to assure maximum benefits from the trust. |
|
1-14 |
     42-12.4-5. Administration. -- The department of human services, designated by section |
|
1-15 |
42-12-9 to have responsibility for traumatic brain injury rehabilitation, shall administer the fund. |
|
1-16 |
     42-12.4-6. Fund. -- (a) The brain injury trust fund shall be funded monies collected from |
|
1-17 |
an additional assessment of twenty dollars ($20.00) imposed on driving under the influence |
|
1-18 |
offenses, an additional assessment of ten dollars ($10.00) imposed against selected speeding |
|
1-19 |
offenses, and an additional fine of ten dollars ($10.00) imposed against selected moving |
|
2-1 |
violations, such as the seat belt law. |
|
2-2 |
     (b) Funds unexpended at the close of a fiscal year shall not lapse but shall be carried |
|
2-3 |
forward to the next fiscal year. |
|
2-4 |
     (c) Any interest earnings of the trust fund shall become a part of the trust fund and shall |
|
2-5 |
not lapse to the general fund. |
|
2-6 |
     SECTION 2. This act shall take effect on January 1, 2003. |
