RELATING TO HEALTH AND SAFETY - CATHODE RAY TUBE CONTROL | |

It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Title 23 of the General Laws entitled "Health and Safety" is hereby |
|

amended by adding thereto the following chapter: |
|

     CHAPTER 60.2 |
|

CATHODE RAY TUBE CONTROL |
|
1-5 |
     23-60.2-1. Cathode ray tube - Distribution. - - No product which includes a cathode ray |
|
1-6 |
tube shall be offered for final sale or use or distribution for promotional purposes in the state of |
|
1-7 |
Rhode Island until such time as the manufacturer of said product either on its own or in concert |
|
1-8 |
with other persons has implemented a plan approved by the department of health for a convenient |
|
1-9 |
and accessible collection system for such products when the consumer is finished with them. |
|
1-10 |
Where a cathode ray tube is a component of another product, the collection system must provide |
|
1-11 |
for removal and collection of the cathode ray tube component or collection of both the cathode |
|
1-12 |
ray tube component and the product containing it. |
|
1-13 |
     23-60.2-2. Collection of cathode tubes. - - The collection system plan submitted to the |
|
1-14 |
department pursuant to section 23-60.2-1 shall include the following elements: |
|
1-15 |
     (1) a public education program to inform the public about the purpose of the collection |
|
1-16 |
program and how to participate in it; |
|
1-17 |
     (2) a targeted capture rate of ninety-five percent (95%) or more for the cathode ray tubes |
|
1-18 |
and/or the product containing it; |
|
1-19 |
     (3) a plan for implementing and financing the collection system; |
|

     (4) documentation of the willingness of all necessary parties to implement the proposed |
|
2-2 |
collection system; |
|
2-3 |
     (5) a description of the performance measurers to be utilized and reported by the |
|
2-4 |
manufacturer to demonstrate that the collection system is meeting capture rate targets and other |
|
2-5 |
measurers of program effectiveness as required by the department of health; and |
|
2-6 |
     (6) a description of additional or alternative actions that will be implemented to improve |
|
2-7 |
the collection system and its operation in the event that the program targets are not met. The |
|
2-8 |
collection system plan may utilize or expand on existing collection and recycling infrastructure |
|
2-9 |
where feasible and cost-effective. Any plan submitted which does not utilize existing collection |
|
2-10 |
and recycling infrastructure shall describe the reasons for establishing a separate collection |
|
2-11 |
system. Where establishing a separate system, manufacturers are required to develop, implement, |
|
2-12 |
and maintain the collection system, alone or in conjunction with other entities. |
|
2-13 |
     23-60.2-3. Cathode ray tube - Reporting. - - No later than two (2) years following the |
|
2-14 |
implementation of the collection system plan required under section 23-60.2-1 and biennially |
|
2-15 |
thereafter, the manufacturer or entity that submitted the plan on behalf of the manufacturer and is |
|
2-16 |
implementing said plan shall be required to submit a report to the department on the effectiveness |
|
2-17 |
of the collection system. The report shall include an estimate of the numbers of cathode ray tubes |
|
2-18 |
that were collected, the capture rate for the cathode ray tubes or components, the results of the |
|
2-19 |
other performance measurers included in the manufacturers collection system plan, and such |
|
2-20 |
other information as the department of health may require. Such reports shall be made available |
|
2-21 |
to the public by the department of health. |
|
2-22 |
     SECTION 2. This act shall take effect upon passage. |
