A N A C T

RELATING TO PUBLIC PROPERTY AND WORKS -- ACQUISITION OF LAND

     Introduced By: Representatives Lima, Naughton, Gallison, and Almeida

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 37-6 of the General Laws entitled "Acquisition of Land" is hereby

amended by adding thereto the following section:

     37-6-13.2. Limitations on acquisition of land. – No taking of private property for public

1-4

use under the provisions of this chapter shall in any instance result in ownership of that property

1-5

in any private entity or individual not related to this state or a municipality or any subdivision

1-6

therein in an amount greater than twenty percent (20%) of non-state ownership.

     It is the express intent of this section that the state or municipality shall not use powers

1-8

over acquisition of land to benefit a private party or entity to the detriment of another private

1-9

party or entity unless the general assembly expressly provides otherwise.

     SECTION 2. This act shall take effect on July 1, 2006.

BY THE LEGISLATIVE COUNCIL

     This act would limit the state, municipalities and their subdivisions from using

condemnation proceedings to benefit a private party at the expense of another private party and

2-3

would limit private ownership in any such taking to twenty percent (20%) or less.

     This act would take effect on July 1, 2006.
