A N A C T

RELATING TO PUBLIC PROPERTY AND WORKS -- ACQUISITION OF LAND

     Introduced By: Representatives Lima, Naughton, Gallison, and Almeida

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 37-6 of the General Laws entitled "Acquisition of Land" is hereby

amended by adding thereto the following section:

     37-6-13.2. Limitations on acquisition of land. – (a) Notwithstanding any provision of

law to the contrary, no public corporation, municipality, quasi-state agency, state agency, or any

1-5

political subdivision thereof, shall exercise their power of eminent domain to acquire private

1-6

property for the purpose of conferring a private benefit or use for a particular private entity.

     (b) Nothing in this chapter shall abrogate or diminish the provisions of Chapters 31 and

1-8

32 of Title 45.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would prohibit the state municipalities and related entities from using eminent

domain to acquire private property to confer a private benefit on a particular private entity,

subject to certain provisions of the general and public laws.

     This act would take effect upon passage.
