RELATING TO LIBRARIES -- STATE PUBLICATIONS CLEARING HOUSE

It is enacted by the General Assembly as follows:

     SECTION 1. Sections 29-7-5 and 29-7-8 of the General Laws in Chapter 29-7 entitled

"State Publications Clearinghouse" are hereby amended to read as follows:

     29-7-5. Deposits of state publications. -- Each state agency shall designate one person

as its documents officer and shall notify the clearinghouse of his or her identity. The documents

1-5

officer shall, prior to public release of a state publication, deposit with the clearinghouse a

1-6

minimum of twenty-five (25) copies of publications that are produced in printed or other tangible

1-7

forms and for electronic publications, one electronic copy and as many tangible copies as are

1-8

specified by the clearinghouse director certified to the documents officer by the clearinghouse as

1-9

required to meet the needs of the depository library system.

     29-7-8. Clearinghouse advisory committee. -- There shall be a state Publications

1-11

Clearinghouse Advisory Committee. The committee shall consist of eight (8) nine (9) members,

five (5) of whom to be selected from the Clearinghouse member libraries and appointed by the

1-13

State Librarian to two (2) year terms. The State Librarian and the Director of the Clearinghouse

shall be ex-officio members of the committee. The chairperson of the CRIARL Government

1-15

Documents Committee and a state agency representative designated by the chief information

1-16

officer shall also be ex-officio members. The purpose of the Committee shall be to advise the

State Librarian and the Clearinghouse Director on the operation of the State Publications

1-18

Clearinghouse for Libraries. The Committee shall meet quarterly and shall elect a chairperson to

preside at meetings, and a secretary to record the meeting minutes and distribute them to the

Clearinghouse depository libraries.

     SECTION 2. Section 42-8.1-20 of the General Laws in Chapter 42-8.1 entitled "State

2-3

Archives" is hereby amended to read as follows:

     42-8.1-20. Rhode Island Historical Records Trust established. -- (a) There is hereby

2-5

established a special fund to be known as the Rhode Island Historical Records Trust (hereinafter

2-6

called Trust).

      (b) There is hereby imposed an additional assessment of two dollars ($2.00) four dollars

2-8

($4.00) for every instrument filed for recording pursuant to sections 33-22-21 and 34-13-7.

      (c) On the first of every month, the municipal clerk shall transmit to the State Archives

2-10

one half of the additional assessment collected under subsection (b) of this section for deposit in

2-11

the Rhode Island Historical Records Trust. The remaining one half of each such additional

2-12

assessment shall remain with the local government and be deposited in a local Historical Records

2-13

Trust.

      (d) All monies retained by a local government shall be placed in a Historical Record

2-15

Trust Fund maintained by the local government. The expenditure of these monies shall be

2-16

restricted solely to the preservation of public records of historical value maintained by the

2-17

municipal clerk or by a municipal archives.

      (e) Use of these funds by the State Archives shall be for the development and ongoing

2-19

maintenance of a full-time local government records management program component and the

2-20

state archives and records program. Such program shall be responsible for providing aid, advice,

2-21

and assistance to all local governments of this State concerning the proper management and

2-22

preservation of the public records in their custody or care, as required by other provisions of

2-23

statute. Funds shall be expended to support administrative and other costs associated with the

2-24

provision of consultative and technical services including, but not limited to, educational

2-25

programming, micrographics services, and ongoing storage and preservation of local government

2-26

records.

      (f) All monies received by the General Treasurer and other moneys appropriated or

2-28

received for the purposes stated in subsection (b) above shall be deposited in a restricted account

2-29

which shall be administered by the State Archives.

      (g) Each year the State Archives shall review and make recommendations on a proposed

2-31

operational and expenditure plan for the RI Historical Records Trust.

     SECTION 3. Section 42-8-22 of the General Laws in Chapter 42-8 entitled "Department

of State" is hereby repealed.

     42-8-22. Central registration register. -- The secretary of state shall appoint not less

than two (2) assistants in charge of the central registration register, one of whom shall be selected

3-2

from a list of three (3) names submitted to him or her by the state chairperson of the political

3-3

party other than that of the secretary of state, all of whom shall serve at the pleasure of the

3-4

secretary of state, whose duties shall be to maintain the central registration register of all persons

3-5

qualified to vote in the state.

     SECTION 4. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO LIBRARIES -- STATE PUBLICATIONS CLEARING HOUSE

     This act would amend the state publications clearinghouse law to provide for the filing of

state publications in electronic form. It would also add a representative designated by the chief

4-3

information officer to the state publications clearinghouse advisory committee. The act would

4-4

also increase the assessment for every instrument filed for recording in the probate courts and

4-5

land evidence records in all cities and towns. Additionally, it would repeal the provision of the

4-6

general laws which would provide for the appointment, by the secretary of state, of assistants to

4-7

be in charge of the central registration register.

4-8

     This act would take effect upon passage.
