A N A C T

RELATING TO CRIMINAL PROCEDURE -- ARREST

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 12-7 of the General Laws entitled "Arrest" is hereby amended by

adding thereto the following section:

     12-7-22. Notification by arresting agency. – It shall be the responsibility of each

arresting agency to notify the United States Immigration and Customs Enforcement Agency

1-5

(ICE) if an officer who has detained or arrested a juvenile has reason to believe that the detained

1-6

or arrested juvenile is in the United States illegally. Such notification shall be made as soon as

1-7

practically possible.

     SECTION 2. This act shall take effect upon passage.
