RELATING TO CRIMINAL OFFENSES -- THEFT, EMBEZZLEMENT -- | |

It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Chapter 11-41 of the General Laws entitled "Theft, Embezzlement, False |
|
1-2 |
Pretenses, and Misappropriation" is hereby amended by adding thereto the following section: |
|
1-3 |
     11-41-33. State employees assisting in the wrongful procurement of benefits. – |
|
1-4 |
Whoever, being an officer, agent or employee of the state of Rhode Island, or any department, |
|
1-5 |
agency or instrumentality or political subdivision of the state, or any city or town, knowingly |
|
1-6 |
provides and/or assists in the procurement of any (1) document or information, including, but not |
|
1-7 |
limited to, driver's license, birth certificate, marriage certificate, social security number, tax |
|
1-8 |
identification number, bank account number, credit card number, or driver's license number; or |
|
1-9 |
(2) any state benefits to any individual illegally residing or living within the state of Rhode Island |
|
1-10 |
shall be fined not more than ten thousand dollars ($10,000) or imprisoned not more than ten (10) |
|
1-11 |
years, or both. |
|
1-12 |
     SECTION 2. This act shall take effect upon passage. |

     This act would make it a felony for any state or municipal employee to knowingly |

provide and/or assist in the procurement of any document, information, or state benefits to anyone |

illegally residing or living within the state of Rhode Island. |

     This act would take effect upon passage. |
