RELATING TO LABOR AND LABOR RELATIONS - ILLEGAL IMMIGRANT WORKERS | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Title 28 of the General Laws entitled "LABOR AND LABOR |
|

RELATIONS" is hereby amended by adding thereto the following chapter: |
|

     CHAPTER 28-54 |
|
1-4 |
THE LEGAL EMPLOYMENT PROTECTION ACT |
|
1-5 |
     28-54-1. Short title. -- This act shall be known and may be cited as the "Legal |
|
1-6 |
Employment Protection Act." |
|
1-7 |
     28-54-2. Hotline established. -- The state police shall establish a hotline for the purpose |
|
1-8 |
of allowing the general public to directly report the suspected employment of illegal immigrants. |
|
1-9 |
     28-54-3. Penalties. -- It shall be a felony, punishable by a fine of three thousand dollars |
|
1-10 |
($3,000) for each separate offense, to employ a worker within the state who is not a United States |
|
1-11 |
citizen or who has no federal authorization to seek and obtain employment. |
|
1-12 |
     28-54-3. Disposition of fines collected. -- Fines collected in accordance with the |
|
1-13 |
provisions of this chapter shall be divided as follows: twenty-five percent (25%) to the individual |
|
1-14 |
providing the information necessary to begin an investigation, and seventy-five percent (75%) to |
|
1-15 |
the state police for use in training state and local police officers in immigration law and |
|
1-16 |
procedure. |

     SECTION 2. This act shall take effect upon passage. |

     This act would make it a state offense to employ an illegal immigrant within the state and |
|

impose a fine on the employer, the proceeds of which to be shared between the state police and |
|

the person providing information which leads to an investigation. |

     This act would take effect upon passage. |
