A N A C T

RELATING TO LABOR AND LABOR RELATIONS - ILLEGAL IMMIGRANT WORKERS

It is enacted by the General Assembly as follows:

     SECTION 1. Title 28 of the General Laws entitled "LABOR AND LABOR

RELATIONS" is hereby amended by adding thereto the following chapter:

     CHAPTER 28-54

THE LEGAL EMPLOYMENT PROTECTION ACT

     28-54-1. Short title. -- This act shall be known and may be cited as the "Legal

1-6

Employment Protection Act."

     28-54-2. Hotline established. -- The state police shall establish a hotline for the purpose

1-8

of allowing the general public to directly report the suspected employment of illegal immigrants.

     28-54-3. Penalties. -- It shall be a felony, punishable by a fine of three thousand dollars

1-10

($3,000) for each separate offense, to employ a worker within the state who is not a United States

1-11

citizen or who has no federal authorization to seek and obtain employment.

     28-54-3. Disposition of fines collected. -- Fines collected in accordance with the

1-13

provisions of this chapter shall be divided as follows: twenty-five percent (25%) to the individual

1-14

providing the information necessary to begin an investigation, and seventy-five percent (75%) to

1-15

the state police for use in training state and local police officers in immigration law and

1-16

procedure.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would make it a state offense to employ an illegal immigrant within the state and

impose a fine on the employer, the proceeds of which to be shared between the state police and

the person providing information which leads to an investigation.

     This act would take effect upon passage.
