RELATING TO PROPERTY - RESIDENTIAL LANDLORD AND TENANT ACT | |

It is enacted by the General Assembly as follows: | |

SECTION 1. Chapter 34-18 of the General Laws entitled "Residential Landlord and |
|

Tenant Act" is hereby amended by adding thereto the following section: |
|

34-18-58. Inquiries regarding immigration status. -- (a) No landlord or any agent of |
|
1-4 |
the landlord shall: |
|
1-5 |
(1) Make any inquiry regarding or based on the immigration or citizenship status of a |
|
1-6 |
tenant, prospective tenant, occupant, or prospective occupant of residential rental property; or |
|
1-7 |
(2) Require that any tenant, prospective tenant, occupant, or prospective occupant of the |
|
1-8 |
rental property make any statement, representation, or certification concerning his or her |
|
1-9 |
immigration or citizenship status. |
|
1-10 |
(b) No municipality or housing agency shall compel a landlord or any agent of the |
|
1-11 |
landlord to make any inquiry, compile, disclose, report, or provide any information, prohibit |
|
1-12 |
offering or continuing to offer, accommodations in the property for rent or lease, or otherwise |
|
1-13 |
take any action regarding or based on the immigration or citizenship status of a tenant, |
|
1-14 |
prospective tenant, occupant, or prospective occupant of residential rental property. |
|
1-15 |
(c) Nothing in this section shall prohibit a landlord from either: |
|
1-16 |
(1) Complying with any legal obligation under federal law; or |
|
1-17 |
(2) Requesting information or documentation necessary to determine or verify the |
|
1-18 |
financial qualifications of a prospective tenant, or to determine or verify the identity of a |
|
1-19 |
prospective tenant or prospective occupant. |

SECTION 2. This act shall take effect upon passage. |

This act would provide that no landlord or agent of the landlord may make an inquiry, |

regarding immigration or citizenship status of a tenant, prospective tenant, occupant or |
|

prospective occupant nor may it be required that any of the above-mentioned make any statement, |
|
3-4 |
representation, nor certification concerning his or her immigration status to the landlord or agent |
|
3-5 |
of the landlord. |
