It is enacted by the General Assembly as follows: | |

SECTION 1. Chapter 13-12 of the General Laws entitled "Transfer of Prisoners to |
|

Federal Penitentiaries" is hereby amended by adding thereto the following section: |
|

13-12-4. Transfer of illegal aliens. – (a) Notwithstanding the provisions of section 13- |
|
1-4 |
12-1 and any other general or special laws to the contrary, the director of the department of |
|
1-5 |
corrections shall ascertain the legal status of every inmate of this state. It shall be the duty of the |
|
1-6 |
director of the department of corrections to notify the state attorney general and Immigration and |
|
1-7 |
Customs Enforcement (ICE) of any person determined to be an illegal alien. |
|
1-8 |
(b) The attorney general shall be authorized to contact the proper official (director of the |
|
1-9 |
Bureau of Prisons) of the United States for the transfer of any person determined to be an illegal |
|
1-10 |
alien pursuant to subsection (a) above for the transfer of such illegal alien to the Donald W. Wyatt |
|
1-11 |
Detention Facility in the city of Central Falls pending their processing and deportation by |
|
1-12 |
Immigration and Customs Enforcement (ICE). |
|
1-13 |
SECTION 2. This act shall take effect upon passage. |

require the transfer to the Wyatt facility for deportation. |
