It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Section 28-45-9 of the General Laws in Chapter 28-45 entitled |
|
1-2 |
"Apprenticeship Programs in Trade and Industry" is hereby amended to read as follows: |
|
1-3 |
     28-45-9. Standards of apprenticeship programs. -- An apprenticeship program, to be |
|
1-4 |
eligible for approval and registration with the council, shall conform to the following standards: |
|
1-5 |
      (1) The program is an organized, written plan embodying the terms and conditions of |
|
1-6 |
employment, training, and supervision of one or more apprentices in the apprenticeable |
|
1-7 |
occupation, as defined in this chapter and subscribed to by a sponsor who has undertaken to carry |
|
1-8 |
out the apprentice training program. |
|
1-9 |
      (2) The program standards contain the equal opportunity pledge prescribed in 29 CFR |
|
1-10 |
30.3(b) and, when applicable, an affirmative action plan in accordance with 29 CFR 30.4, a |
|
1-11 |
selection method authorized in 29 CFR 30.5, or similar requirements expressed in a state plan for |
|
1-12 |
equal employment opportunity in apprenticeship adopted pursuant to 29 CFR Part 30 and |
|
1-13 |
approved by the U.S. department of labor, and provisions concerning the following: |
|
1-14 |
      (i) The employment and training of the apprentice in a skilled trade; |
|
1-15 |
      (ii) A term of apprenticeship not less than two thousand (2,000) hours of work |
|
1-16 |
experience, consistent with training requirements as established by industry practice; |
|
1-17 |
      (iii) An outline of the work processes in which the apprentice will receive supervised |
|
1-18 |
work experience and training on the job, and the allocation of the approximate time to be spent in |
|
1-19 |
each major process; |
|
2-1 |
      (iv) Provision for organized, related, and supplemental instruction in technical subjects |
|
2-2 |
related to the trade. A minimum of one hundred forty-four (144) hours for each year of |
|
2-3 |
apprenticeship is recommended. The instruction may be given in a classroom or through trade, |
|
2-4 |
industrial, or correspondence courses of equivalent value, or other forms of self-study approved |
|
2-5 |
by the apprenticeship council; |
|
2-6 |
      (v) A progressively increasing schedule of wages to be paid the apprentice consistent |
|
2-7 |
with the skill acquired which shall average, over the required hours or years for completion, not |
|
2-8 |
less than approximately one half ( 1/2) of the journeyperson's rate. The entry wage shall be not |
|
2-9 |
less than the minimum wage prescribed by the Fair Labor Standards Act, 29 U.S.C. section 201 et |
|
2-10 |
seq., where applicable, unless a higher wage is required by other applicable federal law, state law, |
|
2-11 |
respective regulations, or by collective bargaining agreement; |
|
2-12 |
      (vi) Periodic review and evaluation of the apprentice's progress in job performance and |
|
2-13 |
related instruction, and the maintenance of appropriate progress records; |
|
2-14 |
      (vii) The numeric ratio of apprentices to journeypersons consistent with proper |
|
2-15 |
supervision, training, safety, and continuity of employment |
|
2-16 |
|
|

|
|
2-18 |
|
|
2-19 |
following for the below unlicensed trades: |
|

     (viii) A probationary period reasonable in relation to the full apprenticeship term, with |
|
2-31 |
full credit given for the period toward completion of apprenticeship; |
|
2-32 |
      (ix) Adequate and safe equipment and facilities for training and supervision, and safety |
|
2-33 |
training for apprentices on the job and in related instruction; |
|
2-34 |
      (x) The minimum qualifications required by a sponsor for persons entering the |
|
3-1 |
apprenticeship program, with an eligible starting age not less than sixteen (16) years; |
|
3-2 |
      (xi) The placement of an apprentice under a written apprenticeship agreement that |
|
3-3 |
conforms to the requirements of this chapter. The agreement shall directly, or by reference, |
|
3-4 |
incorporate the standards of the program as part of the agreement; |
|
3-5 |
      (xii) The granting of advanced standing or credit for previously acquired experience, |
|
3-6 |
training, or skills for all applicants equally, with commensurate wages for any progression step so |
|
3-7 |
granted; |
|
3-8 |
      (xiii) Transfer of employer's training obligation when the employer is unable to fulfill his |
|
3-9 |
or her obligation under the apprenticeship agreement to another employer under the same |
|
3-10 |
program with consent of the new employer, the apprentice, and the apprenticeship council; |
|
3-11 |
      (xiv) Assurance of qualified training personnel and adequate supervision on the job; |
|
3-12 |
      (xv) Recognition for successful completion of apprenticeship evidenced by an |
|
3-13 |
appropriate certificate; |
|
3-14 |
      (xvi) Identification of the registration agency; |
|
3-15 |
      (xvii) Provision for the registration, cancellation, and deregistration of the program, and |
|
3-16 |
requirement for the prompt submission of any modification or amendment to it; |
|
3-17 |
      (xviii) Provision for registration of apprenticeship agreements, modifications, and |
|
3-18 |
amendments; notice to the apprenticeship council of persons who have successfully completed |
|
3-19 |
apprenticeship programs; and notice of cancellations, suspensions, and terminations of |
|
3-20 |
apprenticeship agreements and causes for the cancellations, suspensions or terminations; |
|
3-21 |
      (xix) Authority for the termination of an apprenticeship agreement during the |
|
3-22 |
probationary period by either party without stated cause; |
|
3-23 |
      (xx) A statement that the program will be conducted, operated, and administered in |
|
3-24 |
conformity with applicable provisions of 29 CFR Part 30, or a state EEO in apprenticeship plan |
|
3-25 |
adopted pursuant to 29 CFR Part 30 and approved by the U.S. Department of Labor; |
|
3-26 |
      (xxi) Name and address of the appropriate authority under the program to receive, |
|
3-27 |
process, and make disposition of complaints; |
|
3-28 |
      (xxii) Recording and maintenance of all records concerning apprenticeship as may be |
|
3-29 |
required by the U.S. bureau of apprenticeship and training, employment and training |
|
3-30 |
administration or the apprenticeship council and other applicable law. |
|
3-31 |
     SECTION 2. Section 28-27-4.3 of the General Laws in Chapter 28-27 entitled |
|
3-32 |
"Mechanical Trades" is hereby amended to read as follows: |
|
3-33 |
     28-27-4.3. "Pipefitter apprentice," "refrigeration/air conditioning apprentice," |
|
3-34 |
"journeyperson sprinkler fitter apprentice" and "journeyperson sheet metal worker |
|
4-1 |
apprentice" defined -- Duration of apprentice programs. -- (a) "Journeyperson sheet metal |
|
4-2 |
worker apprentice" means any person at least eighteen (18) years of age who is learning or |
|
4-3 |
working at the businesses of sheet metal work under the direct supervision of a sheet metal |
|
4-4 |
contractor or journeyperson sheet metal worker under a registered state sanctioned apprentice |
|
4-5 |
program. |
|
4-6 |
     The direct jobsite supervision ratio for sheet metal worker apprentices shall be one |
|
4-7 |
apprentice to one journeyperson on residential construction projects of four (4) units or less and at |
|
4-8 |
any manufacturing facility. On residential projects with more than four (4) units and all |
|
4-9 |
commercial projects, the jobsite supervision ratio shall be one apprentice to one journeyperson |
|
4-10 |
up to the first three (3) employees on any one jobsite; thereafter the ratio shall be one apprentice |
|
4-11 |
to every three (3) journeypersons. |
|
4-12 |
      (b) "Journeyperson sprinkler fitter apprentice" means any person at least eighteen (18) |
|
4-13 |
years of age who is learning or working at the business of fire protection sprinkler systems under |
|
4-14 |
the direct supervision of a master or journeyperson sprinkler fitter under a registered state |
|
4-15 |
sanctioned apprentice program. |
|
4-16 |
     The direct jobsite supervision ratio for sprinkler fitter apprentices shall be one apprentice |
|
4-17 |
to one journeyperson on residential construction projects of four (4) units or less and at any |
|
4-18 |
manufacturing facility. On residential projects with more than four (4) units and all commercial |
|
4-19 |
projects, the jobsite supervision ratio shall be one apprentice to one journeyperson up to the first |
|
4-20 |
three (3) employees on any jobsite; thereafter, the ratio shall be one apprentice to every three (3) |
|
4-21 |
journeypersons. |
|
4-22 |
      (c) "Pipefitter apprentice" means any person at least eighteen (18) years of age who is |
|
4-23 |
learning or working at the business of pipefitting under the direct supervision of a master |
|
4-24 |
pipefitter or journeyperson pipefitter under a registered state sanctioned apprentice program. |
|
4-25 |
     The direct jobsite supervision ratio for pipefitter apprentices shall be one apprentice to |
|
4-26 |
one journeyperson on residential construction projects of four (4) units or less and at any |
|
4-27 |
manufacturing facility. On residential projects with more than four (4) units and all commercial |
|
4-28 |
projects, the jobsite supervision ratio shall be one apprentice to one journeyperson up to the first |
|
4-29 |
three (3) employees on any jobsite; thereafter, the ratio shall be one apprentice to every three (3) |
|
4-30 |
journeypersons. |
|
4-31 |
      (d) Pipefitter, refrigeration, sprinkler fitter and sheet metal worker apprentice programs |
|
4-32 |
are of a five (5) year duration, except as detailed in section 28-27-4.2, for all Class II limited |
|
4-33 |
licenses. |
|
4-34 |
      (e) "Refrigeration/air conditioning apprentice" means any person at least eighteen (18) |
|
5-1 |
years of age who is learning and working at the business of refrigeration/air conditioning under |
|
5-2 |
the direct supervision of a refrigeration/air conditioning master or journeyperson under a |
|
5-3 |
registered state sanctioned apprentice program. |
|
5-4 |
     The direct jobsite supervision ratio for refrigeration/air conditioning apprentices shall be |
|
5-5 |
one apprentice to one journeyperson on residential construction projects of four (4) units or less |
|
5-6 |
and at any manufacturing facility. On residential projects with more than four (4) units and all |
|
5-7 |
commercial projects, the jobsite supervision ratio shall be one apprentice to one journeyperson up |
|
5-8 |
to the first three (3) employees on any jobsite; thereafter, the ratio shall be one apprentice to every |
|
5-9 |
three (3) journeypersons. |
|
5-10 |
     SECTION 3. Section 5-6-24 of the General Laws in Chapter 5-6 entitled "Electricians" is |
|
5-11 |
hereby amended to read as follows: |
|
5-12 |
     5-6-24. Apprentices -- Registration fee. -- (a) This chapter does not forbid the |
|
5-13 |
employment of one properly limited registered apprentice electrician working with and under the |
|
5-14 |
direct personal supervision of a certificate B licensed journeyperson electrician for the first four |
|
5-15 |
(4) employees on any one jobsite. Thereafter, the ratio of registered apprentice electricians to |
|
5-16 |
journeyperson supervision shall not exceed a ratio of two (2) apprentices for every three (3) |
|
5-17 |
journeypersons on any one jobsite. Additionally, this chapter does not forbid the employment of: |
|
5-18 |
(1) one properly registered apprentice oil burnerperson working with and under the direct |
|
5-19 |
personal supervision of a licensed oil burnerperson; (2) one properly registered apprentice fire |
|
5-20 |
alarm installer working with and under the direct personal supervision of a licensed fire alarm |
|
5-21 |
installer; or (3) two (2) properly registered apprentice electrical sign installer working with and |
|
5-22 |
under the direct personal supervision of a licensed electrical sign installer; (4) one properly |
|
5-23 |
registered apprentice maintenance electrician working with and under the direct personal |
|
5-24 |
supervision of a valid Class C or Class D license holder; or (5) one properly registered apprentice |
|
5-25 |
lightning protection installer working with and under the direct personal supervision of a licensed |
|
5-26 |
lightning protection installer (LPI). Apprentices are required to register with the division of |
|
5-27 |
professional regulation initially upon payment of a fee of twenty dollars ($20.00) per year. |
|
5-28 |
Apprentices are required to register with the division of professional regulation immediately upon |
|
5-29 |
employment with a properly licensed electrical contractor or lightning protection contractor. |
|
5-30 |
      (b) Indentured apprentice electricians are required to work a minimum of eight thousand |
|
5-31 |
(8,000) hours over a period of time of not less than four (4) years and successfully complete one |
|
5-32 |
hundred forty-four (144) hours of related instruction per year in an indentured apprenticeship |
|
5-33 |
program approved by the Rhode Island department of labor and training, to qualify for the |
|
5-34 |
journeyperson "B" electrician examination; provided, however, apprentices may receive credit for |
|
6-1 |
one hundred forty-four (144) hours of classroom training gained in a vocational school authorized |
|
6-2 |
by the board of regents for elementary and secondary education and approved by the Rhode |
|
6-3 |
Island department of labor and training apprenticeship council. Provided, that the test applicant |
|
6-4 |
has possessed for at least four (4) years prior to the filing of the application a certificate of |
|
6-5 |
registration in full force and effect from the department of labor and training of Rhode Island |
|
6-6 |
specifying the person as an indentured apprentice, and the application of an applicant is |
|
6-7 |
accompanied by an affidavit or affidavits of his or her employer or former employers or other |
|
6-8 |
reasonably satisfactory evidence showing that the applicant has been actually engaged in |
|
6-9 |
electrical work as an apprentice in Rhode Island during those four (4) years, or the application is |
|
6-10 |
accompanied by an affidavit or other reasonably satisfactory evidence showing that the applicant |
|
6-11 |
has successfully completed a course of study in a recognized college or university and has |
|
6-12 |
pursued a course of electrical technology for at least two (2) academic years or is the recipient of |
|
6-13 |
an associate degree in electrical technology, and has thereafter been indentured by the department |
|
6-14 |
of labor and training as an apprentice for at least two (2) years and employed as an indentured |
|
6-15 |
apprentice by a duly licensed electrician master in this state for a period of two (2) years, or a |
|
6-16 |
showing that the applicant possesses a certificate of license issued under the laws of another state. |
|
6-17 |
Limited registered apprentice electricians shall be required to work a minimum of four thousand |
|
6-18 |
(4,000) hours over a period of time of not less than two (2) years. |
|
6-19 |
      (c) Indentured apprentice maintenance electricians are required to work a minimum of |
|
6-20 |
six thousand (6,000) hours over a period of time of not less than three (3) years and successfully |
|
6-21 |
complete a one hundred forty-four (144) hours of related instruction per year in an indentured |
|
6-22 |
apprenticeship program approved by the Rhode Island department of labor and training, to qualify |
|
6-23 |
for the journeyperson "M" electrician examination. Provided, however, that the test applicant has |
|
6-24 |
possessed for at least three (3) years prior to the filing of the application a certificate of |
|
6-25 |
registration in full force and effect from the department of labor and training of Rhode Island |
|
6-26 |
specifying the person as an indentured apprentice, and the application of an applicant is |
|
6-27 |
accompanied by an affidavit or affidavits of his or her employer or former employers or other |
|
6-28 |
reasonably satisfactory evidence showing that the applicant has been actually engaged in |
|
6-29 |
electrical work as an apprentice in Rhode Island during those three (3) years. Class M |
|
6-30 |
journeyperson electricians may qualify to take the journeyperson "B" electrician examination |
|
6-31 |
upon registering as a fourth year apprentice and becoming employed by a properly licensed Class |
|
6-32 |
A electrical contractor for that period of time. |
|
6-33 |
      (d) Apprentice lightning protection installers are required to work a minimum of four |
|
6-34 |
thousand (4,000) hours over a period of time of not less than two (2) years to qualify for the |
|
7-1 |
lightning protection installer (LPI) examination. Provided, that the test applicant has possessed |
|
7-2 |
for at least two (2) years prior to the filing of the application a certificate of registration in full |
|
7-3 |
force and effect from the department of labor and training of Rhode Island specifying the person |
|
7-4 |
as an apprentice lightning protection installer, and the application of an applicant is accompanied |
|
7-5 |
by an affidavit or affidavits of his or her employer or former employers or other reasonably |
|
7-6 |
satisfactory evidence showing that the applicant has been actually engaged in lightning protection |
|
7-7 |
work as an apprentice during those two (2) years. |
|
7-8 |
     SECTION 4. This act shall take effect upon passage. |
