It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Chapter 16-57 of the General Laws entitled "Higher Education Assistance |
|

Authority" is hereby amended by adding thereto the following section: |
|

     16-57-6.8. Student assessment fee for municipal services. -- (a) Notwithstanding any |
|
1-4 |
statute, regulation or charter to the contrary, commencing with the fiscal year starting July 1, |
|
1-5 |
2009, every city and town is authorized to assess a fee of one hundred fifty dollars ($150) per |
|
1-6 |
semester, or one hundred dollars ($100) per trimester, upon every private college or university for |
|
1-7 |
each full-time student at a private institution of higher education within said city or town for the |
|
1-8 |
express purpose of off-setting, in part, the municipality's costs of providing police, fire, rescue, |
|
1-9 |
and other municipal services to students. As to an educational institution which has a campus |
|
1-10 |
and/or educational facilities in more than one city or town, the assessment shall be given to the |
|
1-11 |
municipalities on a prorated basis, based upon the student population at the respective campus |
|
1-12 |
and/or educational facility. |
|
1-13 |
     (b) For purposes of this section, a full-time student shall be deemed to be a student |
|
1-14 |
undertaking twelve (12) or more credits in that semester or trimester at the institution. |
|
1-15 |
     (c) Any student who is a bona fide resident of the state of Rhode Island who has |
|
1-16 |
demonstrated payment of real estate taxes by the student or his or her parent or guardian to a |
|
1-17 |
Rhode Island municipality during the relevant semester or trimester shall be exempt from this |
|
1-18 |
student assessment fee. |

     SECTION 2. This act shall take effect upon passage. |

     This act would provide for an assessment of one hundred fifty dollars ($150) per semester |
|

or one hundred dollars ($100) per trimester against private colleges and universities for each full- |
|

time non-resident student at private institutions of higher education. The fee would be |
|
3-4 |
apportioned to the municipality where the students are located to off-set costs for police, fire, |
|
3-5 |
rescue, and other municipal services. |

     This act would take effect upon passage. |
